Welcome to The VERANDA Company. These Terms of Service govern your use of our website (theveranda.com.au) and your purchase of our products. By accessing our website or placing an order, you agree to these terms. If you do not agree, please do not use our website.

1. About Us

This website (theveranda.com.au) is operated by The Trustee for Chordia Family Trust (ABN 79 114 603 979), trading as The Veranda Company (“VERANDA”). References to “we”, “us” and “our” mean The Veranda Company.

2. Eligibility

By placing an order, you confirm that you are at least 18 years old, or that you have the permission of a parent or legal guardian to make the purchase.

3. Account Registration & Security

  • Some features may require you to create an account. You are responsible for keeping your account details confidential and for all activity under your account.
  • You agree to provide accurate, current and complete information and to keep it up to date.

4. Use of Our Website

  • You agree to use our website lawfully and in line with all applicable laws.
  • You must not use our website in any way that could damage, disable, overburden or impair it, or interfere with any other user’s access.
  • We may suspend or terminate your access if we reasonably believe you have breached these terms.

5. Orders & Acceptance

  • Your order is an offer to purchase. A contract is formed only when we accept your order and dispatch your goods or confirm acceptance in writing.
  • We may decline or cancel an order – for example, where stock is unavailable or where a pricing or product error has occurred. If we cancel an order you have paid for, we will refund you in full.

6. Pricing & GST

  • All prices are shown in Australian Dollars (AUD) and include GST unless stated otherwise.
  • We try to keep all product descriptions, images and pricing accurate, but we do not warrant that they are always error-free. We may correct errors and update information at any time without prior notice.
  • Product images are for illustration. As our fireplaces are made from steel, slight variations in finish, colour and surface texture are normal.

7. Title & Risk

Ownership of the goods passes to you once payment has been received in full. Risk in the goods passes to you on delivery to you, or on collection from our warehouse.

8. Product Safety & Responsible Use

Our products are open-flame outdoor appliances. They become extremely hot and can cause serious injury, fire or property damage if used incorrectly. By purchasing, you acknowledge and agree that:

  • You will read and follow all product instructions and safety guidance supplied with the product.
  • You are responsible for safe placement, assembly and use, including keeping the product on a stable, non-combustible surface and a safe distance from buildings, structures, vegetation and anything flammable.
  • You will comply with all local council regulations, fire-safety laws and total fire bans applicable in your area.
  • Products must never be left unattended while in use and must be kept away from children and pets.
  • Products are intended for outdoor use only, unless expressly stated otherwise.

To the extent permitted by law, VERANDA is not responsible for loss or damage arising from misuse of the product, failure to follow the supplied instructions, or failure to comply with applicable fire restrictions or laws. Nothing in this clause excludes your rights under the Australian Consumer Law.

9. Intellectual Property

  • All content connected with our business – including website text, graphics, logos, images, product photographs, product designs (where applicable), marketing material and the VERANDA name – is our property or licensed to us and is protected by intellectual property laws.
  • You may not reproduce, distribute, modify or use any of this content without our prior written permission.

10. Consumer Guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits or excludes any rights or remedies you have under the ACL or other applicable law.

11. Limitation of Liability

To the maximum extent permitted by law, and subject to the consumer guarantees above, we are not liable for any indirect, incidental, special or consequential loss arising from your use of our website or products. Where our liability cannot be excluded but can be limited, our liability is limited to re-supplying the goods or paying the cost of re-supplying them.

12. Force Majeure

We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, extreme weather, fire, industrial action, supplier shortages, transport disruptions, pandemics or government restrictions.

13. Governing Law

These terms are governed by the laws of Victoria, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Victoria.

14. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy and Return & Refund Policy, constitute the entire agreement between you and VERANDA regarding purchases made through veranda.com.au.

15. Changes to These Terms

We may update these terms at any time. The latest effective date will be shown at the top of this page. Continued use of our website means you accept the updated terms.
